When to Use This Form

When monies have been advanced to a person or entity where a property is being used as collateral (security), regardless of amount or description of the document, (i.e.  Charge, Mortgage, Loan).   This form is typically used by lending institutions but may also be used by individuals or companies who have advanced monies to another person.

When to Use This Form

When you are granting leasehold title (a Lease) of a parcel of land, property (or Strata Unit), where the lease term (length) is greater then 2 years (taking into account options to extend) and where the Lease is to another person including:

  • Third Parties
  • Family Members
  • Companies
  • Trustees
 

This form should be used for both Leases and Sub Leases (where a Leaseholder grants a right to another person), however slightly different information should be provided in each instance.  It can also be used for Variation of an existing Lease.

Whilst it is not compulsory to Register a lease where the term (length) is less than 2 years, you may choose to do so in accordance with these instructions.

Submission Requirements

In submitting this form, you should enclose the following (where applicable):

  • Completed submission record, ensuring checklist to the rear of the form is completed
  • A plan, clearly indicating the premises under Lease where only part of a parcel is being lease, and ideally stating the area
  • The consent of the Charger to the Lease (if there is a Charge / Mortgage over the premises)
  • The consent of the Landlord / Head Lessee to the Lease (Sub-Lease only)
  • A declaration or request to remove any existing Leases over the premises being Leased (if applicable) (Not applicable if existing Lease is in the name of the same Tenant, and of the same premises) 
  • Copy of Certificate of Good Standing (companies only)
  • Permission to hold property from Minister of Finance (exempt companies only)
  • Removal of any Restrictions or Cautions (if required)
  • Certified Copies for Caymanian Stamp Duty Concession (Leases Terms only in excess of 30 years)
  • Waiver letter from Minister of Finance (if applicable)
  • Chattels List (if deduction for Chattels made)

Information on Specisfic Transaction Types

Subleases

  • Ensure that the Head Lease number is recorded on the RL8 form as part of the Parcel number.  ie.  Parcel 159/12
  • A Sub-Lease can only be granted for a Term equal to or less than the residual term of the Head Lease.  For instance a Sub Lease for 5 years cannot be granted if a Head Lease expires in 4 years. 

Variation of Lease

  • Ensure that the Lease number is recorded on the RL8 form as part of the Parcel number. ie.  Parcel 159/12
  • Use the same RL8 for as for a new lease, but write or type the words 'Variation of' in front of the document title
  • Outline in the body of the document the variations that are to be made to the Lease or refer to an attached schedule.

When to Use This Form

When you have been granted rights to administer the estate of a deceased person, and in performing that function are transferring property to persons entitled to the estate under the Will or an Intestacy (where no Will was prepared).

When to Use This Form

Use this form when you are transferring freehold title of an undivided share in parcel of land (or Strata Unit) to another person including:

  • Third Parties
  • Family Members
  • Companies
  • Trustees
  • Transfers where there is no change in beneficial ownership (i.e. from an individual to a wholly owned company)
 

An undivided share is a proportional ownership (i.e. 1/3) of a property, held in conjunction with other shareholders.  One share in the property can be held by multiple persons, however only as joint proprietors (i.e.  with all owners having an equal undividable ownership of the share)

Submission Requirements

In submitting this form, you should enclose the following (where applicable):

  • Completed submission record, ensuring checklist to the rear of the form is completed
  • Consent of other shareholders to the Transfer (except where the Transfer is to an existing proprietor in common of the same land).  Consent of the other shareholders cannot be unreasonably withheld.  If this is not supplied the Registrar will seek consent, which will result in a delay in the completion of Registration. 
  • Copy of Certificate of Good Standing (companies only)
  • Permission to hold property from Minister of Finance (exempt companies only)
  • Removal of any Restrictions or Cautions (if required)
  • Certified Copies for Caymanian Stamp Duty Concession

    • Grandfather or Grandmother, and Grandson or Granddaughter
  • Property may pass between extended family members in a single transaction providing that evidence of the relationship chain can be shown. The Stamp Duty fee shall apply separately to each ‘link’ in the relationship chain. i.e., a Transfer from Uncle to Niece would be considered as Uncle – Mother (CI $50), Mother – Daughter (CI $50). No further Registration Fees would be applied.

When to Use This Form

When you are transferring a right to take the profits from land to another person or entity, such as produce, minerals or animals.  Typical rights include grazing rights and mineral / quarrying extraction.

When to Use This Form

The Transfer of property by the Chargor using powers documented within a typical Charge agreement when a Chargee defaults on the agreement.  Typically, when a property owner fails to keep up with mortgage repayments, the lender will commence repossession proceedings, the last step of which is the sale of the property (to recover the funds advanced), for this this form is used. 

This is a specialist document, which can only in conjunction with a Court Order

When to Use This Form

When you want to temporarily stop any changes from occuring to a Land Register in order to complete a transaction with certainty as to the content of the Register.

When to Use This Form

When you are transferring property through transmission, namely the passing of land without the signature of the owner, and typically therefore utilised in the case of;

  • Death of the Proprietor, where the property is being trasmitted to the Administrator or to another person on the direction of the Administrator or Courts
  • Bankruptcy, where the property is being transmitted on the direction of the Courts
  • Compulsory Acquisition, where the property is being transmitted by order of made under the Land Acquisition Law, and (except in exceptional circumstance) where the Courts have made an order of compensation payable

Submission Requirements

In submitting this form you should enclose the following (where applicable):

  • Documentation to support the tranmission, typically a Grant of Probate, Court Order, or letter of Administration
